Terms of Service

Last updated: 2 November 2026

These Terms govern your use of the hxa.net website, console and API (the "Service"), operated by OpenMax Pte. Ltd. ("we"). By creating an account or using the Service, you agree to these Terms.

1. Agreements take precedence

If you have signed a separate agreement with us, that agreement prevails over these Terms where they differ.

2. The Service

hxa.net provides unified API access to AI models from third-party providers. Model availability and features depend on those providers and may change.

3. Accounts

You are responsible for activity under your account and API keys, and must keep them secure.

4. Billing

The Service is prepaid and billed by usage, at the rates published on our pricing page or set out in your agreement. Payments are processed by our payment provider.

5. Refunds

Unused prepaid balance may be refunded on request to the original payment method. Used balance, promotional or bonus balance, and balance on accounts closed for breach of these Terms are not refundable. Usage charged in error is corrected by restoring your balance; duplicate payments are refunded to the original payment method. To request a refund, email [email protected] from your account email with the payment details.

6. Acceptable use

You must not use the Service in violation of any law or of the underlying model providers' usage policies; abuse, attack or circumvent the Service's limits or security; or resell, share or provide access to the Service to third parties without our written consent. We may suspend or close accounts that breach these rules.

7. No warranty and limitation of liability

The Service is provided "as is" and "as available", without any warranty or service level commitment. Model outputs are generated by third-party models and may be inaccurate; you are responsible for how you use them.

We are not liable for any failure, delay or loss caused by events outside our reasonable control, including outages, errors, changes or retirement of upstream model providers, network or infrastructure failures, and other force majeure events.

Because the Service is billed only for actual usage, if a request fails because of a fault on our side, your sole remedy is that the request is not charged, or the charged balance is restored. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and our total liability for any claim shall not exceed the fees you paid for the affected usage. Nothing in these Terms excludes liability that cannot be excluded by law.

8. Changes and governing law

We may update these Terms and will post the updated version on this page. These Terms are governed by the laws of Singapore.
